The full story of why I need a rebuild/new motor is coming after settling some legal stuff but I thought I could throw this question out in the mean time. Either the engine or the entire car is going to Korman in Greensboro, NC for a rebuild. But I have some options.

If you're in a state/county that requires emissions testing/certification it won't pass.

Go with the stroker. You seem to have been itching to do it for a while. It'll be more fun, and won't really affect the car's value by being less original.

Is there a legitimate reason or is this in the same way that "cold air intakes are illegal" but I've passed with one no problem

It won't let me vote, but I'd go with the original.

Not emissions legal could mean two things (one being bad, and the other not-so-bad)

The bad part is if the emissions levels are above 1989 standards (or whatever year your car is)

However, it is OK if the emissions levels are above that of a stock engine, but still within 1989 limits (if your M3 isn't an 89, then simply substitute the correct year)

Fun fact: most states' tailpipe tests include an allowance for wear and tear, meaning that even if the stroker doesn't meet the 1989 standards, it may still be able to pass inspection, but of course you get the stroker at your own risk.

I'd say keep it original. I'm pretty sure the CCC M3 is all original, but benefits quite nicely from a custom exhaust (less back pressure), upgraded intake, upgraded ECU, and most importantly a mild cam. Feels way torquier than the fully stock S14 in the M2.
